1. Agreement to Terms

These Terms and Conditions ("Terms", "Agreement") constitute a legally binding agreement between you ("User", "Player", "you") and merrph ("merrph", "we", "us", "our"), governing your access to and use of the merrph online gaming platform located at https://merrph.cam and any related services, features, content, and applications offered by merrph (collectively, the "Service"). By registering an account with merrph, depositing funds, placing bets, playing games, or otherwise accessing the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, together with our Privacy Policy and Responsible Gaming Policy, which are incorporated into these Terms by reference.

If you do not agree to these Terms in their entirety, you must not access or use the merrph Service. We reserve the right to modify, amend, or update these Terms at any time without prior notice. Continued use of the Service following any such changes constitutes your acceptance of the modified Terms. It is your responsibility to review these Terms periodically for updates.

2. Eligibility and Account Registration

2.1 Age and Jurisdiction Requirements

The merrph Service is intended exclusively for users who are at least twenty-one (21) years of age and who reside in the Republic of the Philippines. By registering an account, you represent and warrant that:

• You are 21 years of age or older;
• You are a resident of the Philippines and are physically located within Philippine territory at the time of account registration and each time you access the Service;
• You are legally capable of entering into binding contracts under applicable Philippine law;
• You are not prohibited by any applicable law, regulation, or court order from participating in online gaming activities;
• You are acting solely on your own behalf and not on behalf of any third party;
• All information you provide during registration is accurate, current, and complete.

merrph reserves the right to verify your identity, age, and location at any time using government-issued identification documents, proof of address, and other verification methods. Failure to provide requested documentation within the specified timeframe may result in account suspension or closure and forfeiture of funds.

2.2 Account Registration and Security

To use the merrph Service, you must create a personal account by providing accurate registration information including your full legal name, date of birth, email address, mobile phone number, physical address, and creating a secure password. You may maintain only one (1) account with merrph. Multiple accounts, duplicate accounts, or accounts created using false or misleading information are strictly prohibited and will result in immediate closure of all associated accounts and forfeiture of all balances.

You are solely responsible for maintaining the confidentiality of your account credentials (username and password) and for all activities that occur under your account, whether authorized by you or not. You agree to immediately notify merrph of any unauthorized use of your account or any other breach of security. merrph will not be liable for any loss or damage arising from your failure to maintain account security or from unauthorized account access resulting from your negligence.

3. Deposits, Withdrawals, and Payment Processing

3.1 Deposits

merrph accepts deposits via GCash, PayMaya, bank transfer (BPI, BDO, Metrobank, and other major Philippine banks), and other payment methods as displayed on the platform. All deposits must be made in Philippine Pesos (PHP). The minimum deposit amount is ₱100 unless otherwise specified for a particular payment method. There is no maximum deposit limit, but individual payment providers may impose their own transaction limits.

Deposits made via GCash and PayMaya are credited to your merrph account instantly upon successful processing by the payment provider. Bank transfer deposits may take between 10 minutes and 2 hours to reflect in your account depending on the originating bank's processing times. merrph does not charge any fees for deposits; however, your payment provider may assess its own transaction fees.

You acknowledge and agree that all deposits are final and non-refundable except as required by law or in the event of a verified technical error. You may only deposit funds from payment accounts or bank accounts registered in your own legal name. Third-party deposits are strictly prohibited. merrph reserves the right to reject any deposit, reverse any deposit made in violation of these Terms, and return funds to the originating payment method minus any applicable processing fees.

3.2 Withdrawals

You may request a withdrawal of your merrph account balance at any time, subject to the following conditions: (a) you have completed all required identity verification procedures; (b) your account is in good standing with no pending investigations or disputes; (c) you have met any applicable wagering requirements associated with bonuses or promotions; and (d) the withdrawal amount meets the minimum threshold of ₱200.

Withdrawal requests are processed within 5 minutes for GCash and PayMaya during business hours (8:00 AM to 10:00 PM Manila time, Monday through Sunday), and within 15 minutes overnight. Bank transfer withdrawals are processed within 2 business hours during banking hours. All withdrawals must be made to a payment account or bank account registered in your own legal name matching your verified merrph account information. Third-party withdrawals are not permitted under any circumstances.

merrph reserves the right to request additional documentation before processing a withdrawal, particularly for large withdrawal amounts, unusual withdrawal patterns, or first-time withdrawals. We may also implement withdrawal limits (daily, weekly, or monthly) at our discretion to prevent fraud and comply with applicable anti-money laundering regulations. merrph does not charge withdrawal fees for the first three (3) withdrawals per calendar month; subsequent withdrawals may incur a processing fee of 2% of the withdrawal amount, subject to a maximum fee of ₱200.

3.3 Anti-Money Laundering Compliance

merrph operates in accordance with Philippine anti-money laundering laws and regulations, including the Anti-Money Laundering Act of 2001 (AMLA) as amended. We maintain strict policies to prevent money laundering and terrorist financing. All deposits must be wagered at least one (1) time before withdrawal. Deposits that are withdrawn without any wagering activity may be subject to a processing fee of up to 10% or rejection of the withdrawal request.

merrph reserves the right to report suspicious transactions to relevant Philippine authorities including the Anti-Money Laundering Council (AMLC) without prior notice to you. We may freeze or close accounts, confiscate funds, and refuse to process transactions when we have reasonable grounds to suspect money laundering, fraud, or other illegal activity.

4. Bonuses, Promotions, and Wagering Requirements

4.1 General Bonus Terms

merrph offers various bonuses, promotions, free spins, cashback offers, and other incentives ("Bonuses") from time to time at our sole discretion. Participation in any Bonus is optional and subject to specific terms and conditions published on the merrph website or communicated via email, SMS, or in-app notification. All Bonuses are subject to these general Terms in addition to any promotion-specific terms.

Unless otherwise stated, Bonuses are available only to players who have made at least one (1) real money deposit with merrph. Each player, household, IP address, email address, payment account, and device may claim each Bonus only once. Bonus abuse, including but not limited to creating multiple accounts to claim Bonuses repeatedly, coordinating with other players to manipulate Bonus outcomes, or using automated tools to place bets, will result in immediate forfeiture of all Bonuses and associated winnings, closure of all accounts, and potential legal action.

4.2 Wagering Requirements

All Bonuses awarded by merrph are subject to wagering requirements (also known as "rollover" or "playthrough" requirements) before any winnings derived from the Bonus may be withdrawn. The specific wagering requirement for each Bonus is stated in the applicable promotion terms and typically ranges from 1x to 35x the Bonus amount.

For example, if you receive a ₱500 Bonus with a 10x wagering requirement, you must place bets totaling ₱5,000 (₱500 × 10) before any winnings from that Bonus become eligible for withdrawal. Different game types contribute differently toward wagering requirements: slots typically contribute 100%, while table games like baccarat, blackjack, and roulette may contribute 10% to 50% or may be entirely excluded. The specific contribution percentages are stated in each promotion's terms.

Wagering requirements must be completed within the time period specified in the promotion terms, typically 7 to 30 days from the date the Bonus is credited to your account. Failure to meet the wagering requirements within the specified timeframe will result in forfeiture of the Bonus and any winnings derived from it. You may forfeit an active Bonus at any time by contacting merrph customer support, which will also forfeit any associated winnings but restore any remaining real money balance.

5. Gameplay, Betting, and Game Rules

5.1 Games and Random Number Generators

merrph offers a wide variety of gaming products including slot machines, live casino games (baccarat, blackjack, roulette, sicbo, and others), bingo, virtual sports, and sports betting. All games of chance on the merrph platform utilize certified Random Number Generators (RNGs) that have been tested and certified by independent third-party testing laboratories to ensure fair and random outcomes. RNG games are not influenced by previous results, player behavior, bet amounts, or any external factors.

Game rules, paytables, return-to-player (RTP) percentages, and other relevant information are available within each game or in the game information section. It is your responsibility to familiarize yourself with the rules of any game before placing bets. merrph does not guarantee any specific outcome or winning probability beyond the published RTP percentages and paytables.

5.2 Bet Placement and Acceptance

All bets placed on the merrph platform are final once accepted by our system. You are responsible for ensuring that your bet selections, stake amounts, and other bet parameters are correct before confirming the bet. merrph reserves the right to refuse or limit any bet at our sole discretion, particularly in cases of suspected fraud, technical errors, or violation of these Terms.

In the event of a clear technical error (including but not limited to incorrect odds, incorrect game payouts, or system malfunctions), merrph reserves the right to void the affected bets and refund the stake amounts to players. This includes "obvious errors" where odds, spreads, or totals are displayed incorrectly due to human or technical error and do not reflect reasonable market values at the time of bet placement.

5.3 Sports Betting

merrph offers sports betting on a wide range of sporting events including but not limited to basketball (PBA, NBA), football, UFC, boxing, virtual sports, and traditional Philippine games such as sabong (cockfighting). All sports bets are subject to the specific rules applicable to each sport and bet type as published on the merrph website.

If a sporting event is postponed, abandoned, or canceled, merrph will follow standard industry rules for bet settlement, which typically involve voiding bets on canceled events and refunding stakes, unless the event is rescheduled and completed within a specified timeframe (usually 48 to 72 hours). Specific settlement rules for different sports and bet types are available in the Sports Betting Rules section of the merrph website.

6. Responsible Gaming and Self-Exclusion

6.1 Commitment to Responsible Gaming

merrph is committed to promoting responsible gaming and preventing problem gambling. We provide tools and resources to help players maintain control over their gaming activity, including deposit limits, loss limits, session time limits, cooling-off periods, and self-exclusion options. 6.2 Self-Exclusion and Account Closure

You may request temporary or permanent self-exclusion from the merrph platform at any time by contacting customer support via live chat or email. Self-exclusion periods can range from 24 hours to 6 months, 1 year, or permanent closure. During a self-exclusion period, you will not be able to access your account, place bets, or receive promotional communications from merrph.

Any requests to lift a self-exclusion before the expiration of the self-exclusion period will be denied. If you request permanent self-exclusion, your account will be closed permanently and cannot be reopened. Any remaining balance in your account at the time of permanent closure will be returned to you via your registered payment method after deducting any applicable withdrawal fees.

7. Account Suspension, Closure, and Prohibited Activities

7.1 Prohibited Activities

The following activities are strictly prohibited on the merrph platform and will result in immediate account suspension or closure, forfeiture of funds, and potential legal action:

• Creating multiple accounts or using false identity information;
• Sharing account credentials with other individuals or allowing third parties to access your account;
• Using VPNs, proxy servers, or other tools to disguise your location or circumvent geographic restrictions;
• Engaging in collusion, chip dumping, or other forms of coordinated play to gain unfair advantages;
• Using automated betting software, bots, or other technological tools to place bets;
• Exploiting software bugs, technical errors, or security vulnerabilities;
• Engaging in bonus abuse or attempting to manipulate promotions;
• Money laundering, fraud, or any other illegal activity;
• Chargebacks, payment disputes, or providing false information to payment providers;
• Abusive, harassing, or threatening behavior toward merrph staff or other players;
• Any other activity that violates these Terms or applicable laws.

7.2 Account Suspension and Closure

merrph reserves the right to suspend, restrict, or permanently close any account at any time, with or without prior notice, if we have reasonable grounds to believe that the account holder has violated these Terms, engaged in prohibited activities, or poses a risk to the integrity of the merrph platform. In the event of account closure for violation of these Terms, merrph may confiscate any remaining account balance, reverse any pending withdrawals, and pursue legal action to recover damages.

If your account is closed due to suspected fraud, money laundering, or other serious violations, merrph may report the matter to relevant Philippine authorities including PAGCOR, the Anti-Money Laundering Council (AMLC), and law enforcement agencies. We may also share information with other gaming operators to prevent you from opening accounts elsewhere.

8. Intellectual Property Rights

All content, features, functionality, software, designs, graphics, logos, text, images, audio, video, and other materials available on the merrph platform ("Content") are the exclusive property of merrph, our licensors, or our content providers and are protected by Philippine and international copyright, trademark, patent, trade secret, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the merrph Service for personal, non-commercial entertainment purposes only, in accordance with these Terms. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any Content from the merrph platform except as specifically permitted in these Terms or with our prior written consent.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the merrph Service for personal, non-commercial entertainment purposes only, in accordance with these Terms. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any Content from the merrph platform except as specifically permitted in these Terms or with our prior written consent.

If you believe merrph has taken action against your account in error, you may submit a written appeal to our customer support team at [email protected] within thirty (30) days of the action. All appeals must include your account username, detailed explanation of the dispute, and any supporting documentation. merrph will review your appeal and provide a written response within fourteen (14) business days. Our decision on any appeal is final and binding.

9. Limitation of Liability and Disclaimers

9.1 Service Availability

merrph strives to provide uninterrupted access to the Service, but we do not guarantee that the Service will always be available, error-free, or free from viruses or other harmful components. The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

merrph may suspend or terminate access to the Service at any time for maintenance, upgrades, technical issues, or any other reason at our sole discretion. We will not be liable for any loss or damage resulting from Service interruptions, delays, or unavailability.

9.2 Limitation of Liability

To the fullest extent permitted by applicable law, merrph, its affiliates, directors, officers, employees, agents, licensors, and service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, arising out of or related to your access to or use of the Service, whether based on warranty, contract, tort (including negligence), or any other legal theory, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for all claims arising out of or relating to these Terms or the Service shall not exceed the amount you have deposited into your merrph account during the twelve (12) months preceding the event giving rise to the claim, or ₱10,000, whichever is less.

10. Governing Law and Dispute Resolution

These Terms and any disputes arising out of or related to these Terms or the Service shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or related to these Terms shall be brought exclusively in the courts of Metro Manila, Philippines, and you consent to the personal jurisdiction of such courts.

Before initiating any formal legal proceedings, you agree to first attempt to resolve any dispute with merrph through our internal dispute resolution process by contacting customer support. If the dispute cannot be resolved informally within thirty (30) days, either party may pursue formal legal remedies.

11. General Provisions

11.1 Entire Agreement

These Terms, together with our Privacy Policy and Responsible Gaming Policy, constitute the entire agreement between you and merrph regarding the Service and supersede all prior or contemporaneous communications, agreements, or understandings, whether written or oral.

11.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid, illegal, or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the parties' original intent.

11.3 Waiver

No waiver by merrph of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition. Any failure by merrph to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

11.4 Assignment

You may not assign, transfer, or delegate these Terms or your rights and obligations hereunder without merrph's prior written consent. merrph may assign or transfer these Terms or any rights or obligations hereunder at any time without notice or consent. These Terms shall be binding upon and inure to the benefit of the parties and their respective successors and permitted assigns.
